Sales of Information
Gosch Ford Temecula does not engage in transactions to provide any third party with personal information about you in exchange for money. However, some marketing and data analysis arrangements dealers have with third parties could be considered under certain interpretations of the CCPA to involve a “sale” of personal information by the dealer to those parties. As a result, to avoid even the potential of making disclosures inconsistent with the CCPA’s definition of sale, we state that we may “sell,” as that term is defined under the CCPA, the following categories of information about you:

Analytics Information: We use third-party analytics tools to help us measure traffic and usage trends for the website. How Personal information is Used: Personal information we collect is used to provide you with our services, including offers of products, services, and credit. We may also collect your first and last name, your physical address, email address and phone number to provide you quality customer service. Your information may be used to administer a contest, promotion, survey or other website feature or to send periodic emails. Dispute Resolution and Agreement to Arbitrate
By providing information to us, you and we agree that if there is any controversy, claim, action, or dispute arising out of or related to your use of our services or the breach, enforcement, interpretation, or validity of this Policy or any part of it (“Dispute”), both parties shall first try in good faith to settle such Dispute by providing written notice to the other party describing the facts and circumstances of the Dispute and allowing the receiving party 30 days in which to respond to or settle the Dispute.
Both you and we agree that this dispute resolution procedure is a condition precedent that must be satisfied before initiating any litigation or filing any claim against the other party. IF ANY DISPUTE CANNOT BE RESOLVED BY THE ABOVE DISPUTE RESOLUTION PROCEDURE, YOU AGREE THAT THE SOLE AND EXCLUSIVE JURISDICTION FOR SUCH DISPUTE WILL BE DECIDED BY BINDING ARBITRATION ON AN INDIVIDUAL BASIS. ARBITRATION ON AN INDIVIDUAL BASIS MEANS THAT YOU WILL NOT HAVE, AND YOU WAIVE, THE RIGHT FOR A JUDGE OR JURY TO DECIDE YOUR CLAIMS, AND THAT OU MAY NOT PROCEED IN A CLASS, CONSOLIDATED, OR REPRESENTATIVE CAPACITY. The parties expressly agree that this arbitration provision and any arbitration under this agreement is governed and controlled by the Federal Arbitration Act. Other rights that you and we would otherwise have in court will not be available or will be more limited in arbitration, including discovery and appeal rights. All such disputes shall be shall be exclusively submitted to JAMS, at offices closest to our principal place of business in California, for binding arbitration under its rules then in effect, before one arbitrator to be mutually agreed upon by both parties. The arbitrator, and not any federal, state, or local court or agency, shall have exclusive authority to resolve any dispute arising under or relating to the interpretation, applicability, enforceability, or formation of this Policy, including any claim that all or any part of this Policy is void or voidable.
In the event of a conflict between this agreement to arbitrate and any other arbitration agreement between you and us, such as an arbitration agreement contained in a retail installment sales contract, lease agreement, or repair estimate or repair order (Other Arbitration Agreement), the terms of the Other Arbitration Agreement shall govern and prevail in such instance.
